Please Read Carefully These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "Client," or "you") and Oracom Group Limited ("Oracom Group," "we," "us," or "our"). By accessing or using any of our websites, platforms, or services, you agree to be fully bound by these Terms.

Acceptance of Terms

By visiting oracomgroup.com, engaging any of our subsidiary platforms, requesting a quote, purchasing a service, or communicating with our team, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable policies, including our Privacy Policy.

If you do not agree to these Terms in full, you must immediately discontinue use of our websites and services. We reserve the right to modify these Terms at any time, and your continued use of our services after such modifications constitutes acceptance of the updated Terms.

Oracom Group Limited is a Kenyan-registered holding company operating 16 subsidiaries and brands across multiple sectors of the digital economy. Our group includes, but is not limited to, companies involved in:

Each subsidiary may maintain its own supplementary terms where applicable. In the event of a conflict, those subsidiary-specific terms shall prevail for services rendered under that brand.

Services Offered

Oracom Group provides a broad spectrum of digital and technology services to individuals, small-to-medium enterprises (SMEs), corporations, non-profits, and government institutions across Kenya and internationally. Our services are delivered through:

  • Project-Based Engagements: One-time deliverables such as website development, branding, photography, or video production, governed by a formal quotation and work order.
  • Subscription & Retainer Services: Ongoing services including hosting, domain renewals, managed digital marketing, bulk SMS, and maintenance packages billed monthly or annually.
  • Training & Capacity Building: Scheduled classes, workshops, and online courses delivered by certified Oracom instructors.
  • Platform Access: Access to our proprietary platforms (marketplace, SACCO portal, awards portal, search directory, etc.) subject to platform-specific registration requirements.
  • Media & Content Production: Professional multimedia services delivered under agreed scopes of work.
Service AvailabilityAll services are subject to availability, technical feasibility, and mutual agreement. Oracom Group reserves the right to decline any project or service request at its sole discretion without obligation to provide reasons.

User Eligibility & Account Registration

To access certain services, you may be required to register for an account or client portal. By registering, you represent and warrant that:

  • You are at least 18 years of age, or are accessing our services under the supervision of a parent or legal guardian.
  • All information you provide during registration is accurate, current, and complete.
  • You will maintain and promptly update your information to keep it accurate.
  • You are solely responsible for maintaining the confidentiality of your account credentials.
  • You will notify us immediately at info@oracomgroup.com of any unauthorized access to or use of your account.

Oracom Group reserves the right to suspend or terminate any account found to contain false, misleading, or fraudulent information.

Payments, Billing & Refund Policy

5.1 Payment Terms

All prices are quoted in Kenya Shillings (KES) unless otherwise stated. Accepted payment methods include M-Pesa, bank transfer, card payments, and other methods listed on our website. For project-based work, a minimum deposit of 50% is required before any work commences, with the balance due upon completion and before final delivery.

5.2 Subscription Renewals

Subscription services (hosting, domains, retainers) renew automatically at the end of each billing cycle unless cancelled in writing at least 7 days before the renewal date. Oracom Group will send renewal reminders via email or SMS to the contact details on file.

5.3 Late Payments

Unpaid balances after the agreed due date may attract a late payment fee and may result in suspension of active services, including website hosting and email services, until the outstanding amount is settled.

5.4 Refund Policy

  • Deposits are non-refundable once work has commenced, as they cover planning, resource allocation, and initial deliverables.
  • Refunds for hosting and domain services are only considered where a technical fault on our part prevents service delivery, and must be requested within 14 days of the issue.
  • No refunds will be issued for digital products, completed training sessions, downloaded content, or services already fully rendered.
  • Refund requests must be submitted in writing to info@oracomgroup.com and will be reviewed within 7–14 business days.
  • Approved refunds are processed within 14–30 business days via the original payment method.

Intellectual Property Rights

All content, branding, code, designs, logos, trademarks, written materials, photographs, videos, databases, and software developed by or for Oracom Group — including work produced under any subsidiary brand — remain the exclusive intellectual property of Oracom Group Limited until full payment is received for the applicable project.

Upon receipt of full payment, ownership of client-commissioned deliverables (such as a custom website or logo) transfers to the client, except for:

  • Third-party licensed components, plugins, stock assets, and frameworks, which remain subject to their respective license agreements.
  • Oracom Group's proprietary frameworks, methodologies, tools, and reusable code libraries, which are licensed — not transferred — to the client on a non-exclusive basis.
  • Portfolio rights: Oracom Group retains the right to display completed work in our portfolio, case studies, and marketing materials unless explicitly agreed otherwise in writing.

Unauthorized reproduction, redistribution, or resale of any Oracom Group material without prior written consent is strictly prohibited and may result in legal action.

Privacy & Data Protection

Oracom Group is committed to protecting your personal data in compliance with the Kenya Data Protection Act, 2019 and applicable international best practices. By using our services, you consent to the collection, processing, and storage of your personal information as described in our Privacy Policy.

  • We collect personal data (name, email, phone, company information) solely for the purposes of delivering our services, communicating with you, and improving our offerings.
  • We do not sell, rent, or share your personal data with third parties for marketing purposes without your explicit consent.
  • Data may be shared with trusted service providers (payment processors, hosting infrastructure, etc.) strictly necessary for service delivery, all of whom are bound by data protection obligations.
  • You have the right to access, correct, or request deletion of your personal data held by us at any time by contacting info@oracomgroup.com.

Acceptable Use Policy

You agree to use Oracom Group's services, platforms, and digital products only for lawful purposes and in a manner consistent with these Terms. You must NOT:

  • Use our services to transmit, publish, or distribute illegal, defamatory, abusive, harassing, obscene, or fraudulent content.
  • Attempt to gain unauthorized access to our systems, servers, client databases, or any connected networks.
  • Use our hosting, SMS, or WhatsApp services to send unsolicited bulk communications (spam) or conduct phishing activities.
  • Reverse engineer, decompile, or disassemble any of our proprietary software or platforms.
  • Resell or sublicense our services to third parties without prior written authorization from Oracom Group.
  • Use our platforms to host or distribute malware, viruses, or any malicious code.
  • Infringe on the intellectual property rights of Oracom Group or any third party.
  • Use our services in violation of any applicable Kenyan law, including the Computer Misuse and Cybercrimes Act, 2018, and the Kenya Information and Communications Act.
Violation ConsequencesBreach of this Acceptable Use Policy may result in immediate suspension or termination of your account and services, forfeiture of any fees paid, and/or referral to the relevant law enforcement authorities. Oracom Group shall not be liable for any losses you incur as a result of such action.

Limitation of Liability & Disclaimer

Oracom Group's services are provided on an "as is" and "as available" basis. While we strive to deliver excellent, uninterrupted services, we cannot guarantee that our platforms will be error-free or continuously available.

To the fullest extent permitted by applicable law:

  • Oracom Group shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use — or inability to use — our services.
  • Our total aggregate liability to any client for any claim arising out of or related to our services shall not exceed the total fees paid by that client to Oracom Group in the three (3) months preceding the claim.
  • We are not responsible for losses caused by third-party services, internet outages, force majeure events, or circumstances beyond our reasonable control.
  • Client-supplied content (text, images, data) remains the client's responsibility. Oracom Group is not liable for any legal claims arising from client-supplied materials.

Termination of Services

Either party may terminate an ongoing service engagement by providing written notice in accordance with the terms of the relevant service agreement or subscription. In the absence of a specific agreement:

  • Subscription services require a minimum of 30 days' written notice prior to the next billing cycle to avoid charges.
  • Project-based engagements may be terminated by the client at any time; however, fees for work already completed and costs already incurred are non-refundable.
  • Oracom Group may terminate services immediately without notice in the event of a material breach of these Terms, non-payment, or any conduct that poses a risk to our systems, reputation, or other clients.

Upon termination, Oracom Group will facilitate a reasonable transition period to assist with data export and handover, subject to all outstanding invoices being settled.

Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising out of or in connection with these Terms or our services shall first be subject to good-faith negotiation between the parties.

If a dispute cannot be resolved amicably within 30 days of written notice, it shall be submitted to mediation in Nairobi, Kenya. If mediation fails, the dispute shall be referred to binding arbitration under the Nairobi Centre for International Arbitration (NCIA) rules, or to the courts of competent jurisdiction in Nairobi, Kenya.

These Terms constitute the entire agreement between you and Oracom Group with respect to your use of our services, superseding all prior or contemporaneous communications, agreements, and understandings, whether written or oral.
